1 (THE CONTEST PRESENTATION)

• The Cultural Associatio KREATTIVITA ( HTTP://WWW.KREATTIVITA.IT ) launches an international photography contest “KREATTIVITA' COLOURED EMOTIONS” in order to select the photo images for a release on the power of colours further in free download.

2 (THE CONTEST CLOSING DATE)

• Photography works should be submitted WITHIN THE 28 FEBRUARY 2010 via internet by connecting to the official association's site www.kreattivita.it. The compilation of the on-line contest agreement form is the first step a participant to the contest should take. It gives the possibility to choose among the various sections where the photography works can be placed. The works can be submitted even with a time lag yet within the maximum number of works allowed and in respect to the contest deadline. From the moment of its confirmation and till the contest closing date the submitted work will be displayed for the public voting on the association's site www.kreattivita.it.

3 (THE CONTEST PARTICIPANTS)

• The “KREATTIVITA’ Coloured Emotions” contest is open to all the Italian citizens and foreigners, both amateurs and professionals. The underage can participate if an adult enrolling himself assumes the responsibility before the contest regulations and the current law.

4 (THE WORKS SUBMITTED)

• The contest is divided into 12 sections each can be given a free interpretation within each respective colour(WHITE,RED, ORANGE, YELLOW, GREEN, ROSE, SKY-BLUE, BLUE, VIOLETT, BROWN, GRAY, BLACK ). Every participant can upload to the association's site http://www.kreattivita.it maximum THREE high resolution photos in JPG format even with a time lag (kilobytes limit fixed by the download system) The three photo limit is valid for the whole contest itself and it's up to the author's consciousness to submit not more than the maximum number of photos required. The photography works can be placed within one single section or split among more than one section. Whoever suspected of exceeding the maximum number of photos permitted shall be expelled from the contest and the works submitted shall be removed from the association's site http://www.kreattivita.it . The photos can be the scanned from the original as long as the original is realized by the same author. The works can be either edited or unedited, awarded at other contests, as long as not subject to copyright payments to the author himself, other subjects presented or a third party. The photos can be horizontally o vertically formatted. The ratio should not necessarily be that of 4/3. The submission of the images to the contest by the participant to the contest presumes being in possession of a relative copyright. On submitting of the photographic work, the participant assumes full responsibility for their content and authorship. The association will resort to legal actions to recover the damages brought by the author or presumed as such, in case of moral and material damage harmful to the site or the association’s image itself. The author declares having received the consent to the publication and the participation at the contest from the persons identified as photographed. and thus dispense the association with any responsibility before the subjects represented.

5 SUBMITTED WORKS CONFIRMATION)

• Before their actual on-line publication on the association's site http://www.kreattivita.it , the works submitted will be controlled with respect to the article 4 of the present notice. What's more, the promotional committee reserves the right to non accept the images which being realized can cause damage or offence to it's subject. The photos the content of which according to the final judgement of the contest organizators, violates the current law and the contest regulations shall not be admitted to the contest. The association is authorized to modify the photos in order to adapt them to the calendar project, increase their typographic qualities and fit them to be published on the association's site www.kreattivita.it. The association does not assume responsibility for a possible loss of the images or their damage during the transmission.

6 (WORKS VALUTATION)

• The works submitted and confirmed will be published online on the association's site www.kreattivita.it as well as the author's name and if specified a link to a personal website and remain displayed for the public voting till the closing date of the contest. (28 FEBRUARY 2010). Certain security mechanisms will be used to avoid self valuation and gerrymandering. The winner of every category for each colour will be the photo which got the maximum vote. The association though intending to take all the necessary measures to guarantee permanent access to the site, yet does not assume the responsibility in case of a temporary unavailability of the site due to external factors (for example maintenance works, equipment or communication line breakdowns or informatic attacks).

7 (PREMIA)

• The prizes offered by DIGITALPIX are the following:
  For each contest section:
  1st : free printing of 5 photos 20*30/23*30 on the smooth paper (postage costs excluded )
  2nd: free printing of 3 photos 20*30/23*30 on the smooth paper (postage costs excluded )
  3rd : free printing of 3 photos 20*30/23*30 on the smooth paper (postage costs excluded )
  from the 4th to the 10th place 10% discount on the site HTTP://WWW.DIGITALPIX.IT
  The best images for each category provided with the name of the author will be issued in the release on the power of colours which will be realized by the Cultural Association Kreattività in 2010. The Kreattività association reserves the right to modify this article and if necessary article 1 in order to communicate the amount of the prizes and give prominence to the sponsor's generosity. The promotional committee will see to contact the contest winners via email as an act of pure good will. Therefore the official communication of the winner status will consist in the publication itself on the association's site www.kreattivita.it in a place assigned to it.

8 (RESTITUTION/CONSERVATION)

• the materials submitted are not subject to any restituition. The photos, according to the author's will, stated in the on-line registration form, will be either conserved in the associations' archive for future non-commercial uses, or cancelled from the archives.

9 (COPYRIGHT)

• The submission of the images to the contest by the participant presumes being in posession of a relative copyright. The author should be aware of the fact that false declarations are prosecutable under the existing norm. Therefore the association considers itself totally uninvolved in any sort of copyright or other dispute regarding the photos as object of the contest, material and moral damages claim included. Each author is responsible for his own materials and by his participation to the contest authorizes the reproduction of the proper images in the pages of the contest. The winner-images will be released in a calendar for a non-commercial use without any further obligation to the author or the persons photographed, yet with the guaranteed indication of the name of the author. However the author retains the copyright of the images with a consequent prohibition of its transfer to a third party by the association. If otherwise the author's consent to introduce the title of his works in other eventual non-profit publications is literally declared in the online registration form, the reference to his name will be present in a clear and explicit way.

10 (PRIVACY)

• Personal data essential for the compilation of the photography works submission form will be treated in relation with the privacy law. The author participating at the contest gives his consent to Indicate his name, surname, age and legal address next to his proper work receive via email communications relative to the contest or other activities of the association. Article 13 Act 30-6-2003 informs that personal data subject to treatment ? can be treated in a manual or computerized way ? can be communicated only to the subjects authorized by law ? the parties involved enjoy towards the data submitted the rights stated in Act 196/2003 ? the personal data treatment is appointed to the Kreattività association represented by its president

11 (KREATTIVITA RESPONSABILITY)

• Even if the association retains itself free from any responsibility in view of the photography contest regulation, the association offers its maximum collaboration to prevent abuse and improper acts. Having received reasonable reports of an incorrect conduct on the part the contest participants, the association will resort to the reassessment of the author's identity, in other words the association will remove from the site the photos which do not result as the property of the respective author.

12 (OTHER)

• The participation to the photography contest means full acceptance of the present regulation. The contest organizators reserve to themselves the right to modify the regulations to increase the value of the premia or due to force major circumstances. In case of contraversions its more recent version is valid. The regulation is edited in Italian. In case of contraversions connected to the differences generated during the translation process, the original version in Italian is valid.
